Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Nano AI website, applications, and related services (collectively, the “Service”). By creating an account, uploading content, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to the organization.

1. Service Overview

Nano AI provides an AI-powered image editing platform that offers more than 30 Gemini Nano Banana effects, prompt-free presets, and iterative editing workflows. The Service may evolve over time as we introduce new features or retire legacy functionality. We reserve the right to modify or discontinue any part of the Service with reasonable notice when feasible.

Nano AI operates as an independent Creem-approved wrapper product. We provide a custom interface for third-party AI models (including Google's Gemini family) but are not affiliated with, endorsed by, or sponsored by those providers. Model names are mentioned solely to describe compatibility, and any future AI tools would require a separate Creem onboarding outside of this Nano AI product.

2. Eligibility and Account Registration

  • You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.
  • You agree to provide accurate and complete information during registration and to keep your account details current.
  • You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Subscriptions, Trials, and Payments

  • Some features are offered free of charge; others require a paid subscription or usage-based billing. Pricing, plan limits, and available features are described on the Nano AI pricing page.
  • By starting a paid plan, you authorize us and our payment processor to charge the applicable fees to your selected payment method on a recurring basis until you cancel.
  • Taxes and currency conversion fees may apply. You are responsible for any charges assessed by your bank or payment provider.
  • Fees are non-refundable except where required by law or if we expressly provide a refund policy for a specific plan. You may cancel future renewals at any time through your account settings or via the Creem Customer Portal link surfaced in the dashboard; cancellation will take effect at the end of the current billing period.
  • We provide in-product access to the Creem Cancel Subscription API and respond to billing-related requests within three business days.

4. User Content and AI Outputs

  • Your Content: You retain ownership of images, prompts, annotations, and other assets you upload (“User Content”). You grant Nano AI a worldwide, non-exclusive, royalty-free license to host, process, display, and use User Content only as necessary to provide and improve the Service.
  • Generated Content: AI-generated results (“Outputs”) are available for you to download, export, and reuse subject to these Terms and applicable law. Nano AI does not claim ownership of Outputs. Some Outputs may incorporate third-party models or datasets; you are responsible for complying with any usage guidelines that apply.
  • Usage for Improvement: We may use de-identified or aggregated User Content and Outputs to improve effect presets, quality testing, abuse detection, and model safety. You can request exclusion of specific projects by contacting us.

5. Acceptable Use

You agree not to:

  • Upload content that infringes intellectual property, privacy, or publicity rights or that violates applicable laws.
  • Generate or share abusive, hateful, sexually explicit (including non-consensual imagery), or otherwise harmful content.
  • Reverse engineer, modify, or interfere with the Service, or bypass usage limits and security controls.
  • Use the Service to build competing models or datasets without our written consent.
  • Access the Service through automated means (such as scraping) except through published APIs or integrations we authorize.

We may investigate violations and suspend or terminate accounts when necessary to protect our users or the Service.

6. Intellectual Property

The Service, including the website, applications, workflows, designs, templates, and logos, is owned by Nano AI or its licensors and is protected by intellectual property laws. Except for the rights granted in these Terms, all other rights are reserved. You may not copy, distribute, or create derivative works of the Service without our prior written permission.

7. Feedback

If you provide suggestions, feature requests, or other feedback, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or obligation.

8. Privacy

Our Privacy Policy explains how we collect, use, and protect personal information. By using the Service, you consent to the processing of personal data in accordance with the Privacy Policy.

9. Third-Party Services

The Service may include links to third-party products, websites, or integrations. Third-party services are subject to their own terms and privacy policies. We are not responsible for third-party offerings, and your use of them is at your own risk.

10. Availability and Support

We strive to keep the Service available 24/7, but maintenance, outages, or external factors may interrupt access. We may provide different support levels depending on your plan. Support channels and response targets are described on our website.

11. Term and Termination

  • These Terms remain in effect until you or Nano AI terminates them.
  • You may terminate your account at any time via account settings or by contacting support. Termination will not relieve you of outstanding payment obligations.
  • We may suspend or terminate your access if you breach these Terms, fail to pay fees when due, abuse the Service, or create risks for other users. We will make reasonable efforts to notify you via the email associated with your account.
  • Upon termination, your right to access the Service ends, but Sections that by their nature should survive (including Sections 4–7 and 11–19) will remain in effect.

12. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Nano AI disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that Outputs will meet your expectations, be free from errors, or be suitable for every use case.

13. Limitation of Liability

To the extent permitted by law, Nano AI and its affiliates, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from or relating to the Service will not exceed the amounts you paid to Nano AI in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations on implied warranties or exclusion of liability for certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Nano AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your breach of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where Nano AI is established, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service will be resolved through good-faith negotiations. If the parties cannot resolve the dispute amicably within 30 days, the dispute shall be submitted to binding arbitration in that jurisdiction under the rules of a recognized arbitration body mutually agreed by the parties. Nothing in this Section prevents either party from seeking injunctive or other equitable relief in court for matters related to data security or intellectual property rights.

16. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will provide advance notice via email or in-product messaging. The revised Terms take effect on the date indicated. By continuing to use the Service after updates go into effect, you agree to the revised Terms.
